Client means an Individual Customer or a Business Client. The words "you" and "the client" mean the client.
Authorized person means the Individual Customer, or, for a Business Client, an authorized representative.
Authorized representative means a person a Business Client names in writing, including by email, to schedule service, approve estimates, and hand over and receive devices.
Device means any laptop, desktop, server, phone, tablet, printer, network equipment, peripheral, or other item submitted for service or installed by Foxhole IT Solutions.
Service means any repair, diagnostic, setup, support, data recovery, monitoring, maintenance, installation, website, or other work performed by Foxhole IT Solutions.

Office means the Foxhole IT Solutions private workspace in Clearwater, Florida. It is not open to clients.
Business day means a day on which Foxhole IT Solutions is open under its business hours, which is Sunday through Thursday, excluding federal holidays. For purposes of any cancellation right under Florida or federal law, "business day" means any day except Sunday and federal holidays, and this scheduling definition does not shorten any legal cancellation period.
Calendar day means every day of the week, including weekends and holidays.
Business hours are Sunday 9 AM to 5 PM, Monday, Tuesday, and Wednesday 8 AM to 5 PM, and Thursday 11 AM to 7 PM, Eastern Time. Foxhole IT Solutions is closed on Friday and Saturday. Current hours are shown on the Foxhole IT Solutions website and may change.
Primary service location means the Foxhole IT Solutions base in Clearwater, Florida. Travel distance is measured as driving distance on a standard mapping service from that location to the appointment address.
In writing includes a text message, an email, an electronic form, and an electronic signature. A signed writing is a document signed by the person named, including by electronic signature. A text message or email alone is not a signed writing.
Estimate means the price and scope that Foxhole IT Solutions gives for a job, whether verbal or written, including a quote or proposal.
PART 1. TERMS THAT APPLY TO ALL CLIENTS
1. Scope, Acceptance & Agreement
These policies govern every service Foxhole IT Solutions provides. By booking a service, handing over a device, approving an estimate, or checking the acceptance box on a form or agreement, the client agrees to them.
Individual Customers and Business Clients
An Individual Customer is an individual who uses a service for personal, family, or household purposes. Every business, including a sole proprietor, freelancer, or other individual who uses a service for business purposes, is a Business Client. Foxhole IT Solutions tells the client which type applies when the service is booked, and the service intake form, booking form, or agreement identifies it. If a client is not sure, Foxhole IT Solutions decides based on the purpose of the service. A client who uses Foxhole IT Solutions for both purposes is covered by the terms that match the purpose of each service.
Services and Devices
Foxhole IT Solutions services laptops, desktop computers, Macs, and custom-built PCs (Windows, macOS, Linux), mobile phones and tablets (iOS and Android), gaming consoles and controllers, smart home devices, printers, scanners, network equipment, and, for Business Clients, servers, along with other peripheral devices and equipment on a case-by-case basis. Services include diagnostics and troubleshooting, on-site IT support, network, Wi-Fi, printer, and scanner setup, data recovery and data transfer, operating system and software installation, updates, and configuration, virus and malware removal, hardware upgrades such as memory and storage, component-level and micro-soldering repair, and carrier unlock and passcode assistance for verified owners. Monitoring, maintenance, equipment, and website services are available to Business Clients under Part 3. Specific services are listed on the Foxhole IT Solutions website, and each estimate states what is included for the job. Foxhole IT Solutions may decline any work that is unsafe, illegal, or outside the scope of services offered.
Acceptance
The client accepts these policies by checking the policy acknowledgment box on the service intake form, the booking form, or a service agreement. Approving an estimate verbally, by text, or by email, and paying an invoice, also confirm acceptance. Electronic acceptance has the same legal effect as a handwritten signature under Florida's Uniform Electronic Transaction Act and the federal E-SIGN Act. Foxhole IT Solutions keeps an electronic record of each acceptance, including its date and time, and provides a copy on request.
Entire Agreement
These policies, the service intake form, the written or verbal estimate and authorization for the job, any proposal, subscription plan, or service agreement, and the Square invoice together form the full agreement between Foxhole IT Solutions and the client. If any of those documents conflicts with these policies, these policies control, except that a proposal, plan, or estimate controls the scope, price, and timeline of the job it describes.
Policy Changes
Foxhole IT Solutions may update these policies at any time. The version in effect when the service is booked or the agreement is accepted governs that service. Changes apply to a monthly subscription after 30 days' notice to the subscriber. Foxhole IT Solutions makes the current policies available through an unlisted page on its website, sends the client a link when an appointment is booked, shows the version number on the service intake form, and keeps a copy of every version it has issued.
2. Service Intake, Ownership & Authorization
Service Intake
All devices must be checked in with a completed service intake form before any work is performed. The client provides a valid phone number, email address, and mailing address, and describes the issue accurately to the best of their ability. Only an authorized person may schedule service, approve estimates, and hand over and receive devices.
Ownership and Authority
On the service intake form, the client attests in writing that they own each device or are authorized by the owner to have it serviced. A device that belongs to an employee, a client, a lender, a deceased person, or any other third party is the responsibility of the client, who must show written authority to act for the owner before Foxhole IT Solutions accesses or copies any data on it. For a deceased owner, that means court-issued letters of administration or a signed authorization from the personal representative. A valid government-issued photo ID may be required at pickup, at delivery, or both. It is viewed only to confirm identity and is never copied, photographed, or stored. Foxhole IT Solutions may also check a device's serial number or IMEI against public loss and theft databases, and may refuse service under Section 13 if ownership or authorization cannot be reasonably established.
Security Locks and Passcodes
Before service begins, the client must disable Find My iPhone / Find My, Activation Lock, Google Factory Reset Protection (FRP), and any similar anti-theft or account lock on the device, and must unlock the device or provide the passcode, PIN, password, or recovery key needed to test it. Passcodes are used only to test and complete the authorized work and are never recorded or kept. Foxhole IT Solutions does not bypass or break encryption and is not responsible for delays, an inability to complete the work, or additional charges that result from a lock that was not disabled or a credential that was not provided. If a key is lost or unavailable, the data on the device may be unrecoverable, and fees for work performed remain due.
Managed, Leased, and Financed Devices
A device that is owned or managed by an employer, a school, or another organization may be locked by device management profiles, enrollment locks, or remote management. Before service, the client must provide written authorization from the organization's IT administrator. Foxhole IT Solutions does not bypass or remove those controls and may refuse service on a managed device. For a device that is leased, financed, or still owned by a carrier or lender, the client is responsible for confirming that the repair does not breach the lease or financing terms, and Foxhole IT Solutions may require proof that the client has the right to authorize the repair.
Illegal Content and Software Licensing
Foxhole IT Solutions does not search devices for content. If illegal content is encountered during authorized work, Foxhole IT Solutions may stop work, refuse service, and report it to law enforcement as required by law. The client must provide valid licenses for any software to be installed, and Foxhole IT Solutions does not install unlicensed or pirated software.
Suspected Stolen Devices
If Foxhole IT Solutions has reason to believe a device in its custody is stolen or was obtained unlawfully, it may stop work, keep the device secure, and contact the owner of record or law enforcement. It may release the device to law enforcement or to the verified owner on request. Fees for work already completed remain due from the client who submitted the device.
3. Estimates, Pricing & Parts
Estimates and Authorization
A diagnostic assessment is performed before repair work, and a written or verbal estimate is provided before work begins. When an estimate is approved verbally, Foxhole IT Solutions sends an invoice by text or email documenting the estimate and the approval. No work is performed without authorization from an authorized person, and where a deposit is required under Section 4, work does not begin until the deposit has been received. If the client declines the estimate, the diagnostic fee is due and the device is returned as found, reassembled where possible.
Estimate Validity
Estimates are valid for 14 days. After that, pricing and parts availability may change, and a new estimate may be required.
Pricing and Changes
Prices are based on the complexity of the work, parts cost, and labor time. Final pricing does not exceed the estimate without the client's prior approval. If the work grows beyond the estimate, Foxhole IT Solutions pauses and gets approval of a revised estimate before continuing. Work outside the scope of a proposal or estimate needs a new estimate approved in writing. Prices, scope, and terms can be changed only in writing, and a text or email from Foxhole IT Solutions counts as writing. Oral promises and side agreements are not binding.
Diagnostic Fee
The $50.00 diagnostic fee applies to every diagnostic assessment. It is collected when the assessment is performed and is credited toward the final balance if the client approves the repair. It is not refundable.
Hourly Billing
Services billed by the hour are charged at the labor rate in Section 25, with a one-hour minimum. Time after the first hour is billed in 30-minute increments, rounded up to the next increment, including overtime under Section 6. Billable time includes time spent working on the device or system and time spent waiting because the client is not ready, access is delayed, or an approval is pending. Flat-rate work is priced in the estimate and is not billed by the hour. A written plan or prepaid hour block may state a different hourly rate, and that rate then applies to the work it covers.
Rush, Expedited, and After-Hours Work
Rush service covers expedited parts ordering and moving a client ahead of previously scheduled work, with priority within 24 hours. It carries a flat rush fee of $40.00 for Individual Customers and $60.00 for Business Clients, charged once per job. Labor on a rush job is then billed at the after-hours rate in Section 25, which is 1.5 times the labor rate, with a one-hour minimum. Work outside business hours on a day Foxhole IT Solutions is open is also available on request and is billed at the after-hours rate. The rush fee and the rate are stated in the estimate before the work begins. Overtime that falls outside business hours on a day Foxhole IT Solutions is open is also billed at the after-hours rate instead of the labor rate.
Parts
The client is told the type of parts being used before work is authorized. OEM (Original Equipment Manufacturer) parts are made by or for the original manufacturer of the device and are used when available and cost-effective. OEM-grade and aftermarket parts are high-quality third-party components used as an alternative, and they are not made by the original manufacturer. If a quoted part is unavailable or its delivery would cause a long delay, Foxhole IT Solutions may substitute a part of equal or better quality, but only after telling the client about the substitute and its price and receiving the client's approval. If the client declines the substitute, the repair may be cancelled and Section 5 applies. Parts and equipment supplied by Foxhole IT Solutions are not released until they are paid for, and Foxhole IT Solutions may hold the device until the balance is paid, as Section 4 states. Parts removed from a device become the property of Foxhole IT Solutions and are recycled or disposed of in accordance with the law, including lithium batteries, unless the client asks at intake, before work begins, to have them returned.
Client-Supplied Parts
Foxhole IT Solutions may refuse to install a part the client supplies, including a part that cannot be verified as compatible, appears counterfeit or defective, or is unsafe to install. The client confirms in writing that the part is compatible with the device before installation. No warranty of any kind is provided on client-supplied parts or on any damage, failure, data loss, or complication caused by them. The labor warranty in Section 10 covers only the workmanship of the installation itself and does not apply to a failure of the part. Labor, diagnostic, and other fees remain due in full if the part is defective, incompatible, or fails to work.
Purchases and Pass-Through Costs
Parts, cables, drives, and other supplies that Foxhole IT Solutions buys for a job are listed in the estimate or on the invoice. Shipping, domain and hosting renewals, software licenses, payment processing fees charged by third parties, and other third-party costs are billed at cost unless the estimate says they are included. Foxhole IT Solutions gets the client's approval before buying or incurring anything that is not in the estimate, and a text or email approval counts.
4. Payment, Deposits & Billing
Deposit
A deposit of 50% of the estimate is required on any repair, equipment order, or website project whose estimate exceeds $200. Work does not begin, and parts are not ordered, until the deposit has been received. The $200 threshold is measured on the total estimate, before any diagnostic fee credit. The deposit is applied toward the final balance. A diagnostic fee that has been paid is credited against the final balance, not against the deposit. The deposit is a payment toward the client's final bill, not a fee. If the client cancels or the work cannot be completed, the deposit is applied to the charges actually incurred, as stated in Section 5, and any remainder is refunded within 14 days. Foxhole IT Solutions may waive a deposit only in a signed writing.
Invoicing and Payment
Foxhole IT Solutions sends a Square invoice by text or email when the estimate is approved, for the deposit if one is required, and again when the work is complete, for the balance. A required deposit is due when the invoice is sent. The balance is due as stated in Part 2 or Part 3. Paying through the invoice link in advance is encouraged and avoids delays at delivery.
Holding a Device
A device picked up for repair is released when its balance is paid, and Foxhole IT Solutions may hold it until then. Foxhole IT Solutions holds a device only for unpaid charges for work on that device. If the balance is not paid at the handoff, the device is not released and delivery is rescheduled, and the redelivery fee in Section 25 applies. A device held for an unpaid balance remains subject to the storage fee and abandonment timeline in Section 15.
Lien
To the extent the law allows, Foxhole IT Solutions has a lien on a device in its possession for unpaid charges for work on that device and may keep the device until those charges are paid.
Payment Methods
Payment is accepted in cash or by credit or debit card. Business Clients may also pay by bank transfer (ACH) through Square under Part 3. Checks and peer-to-peer payment apps such as Zelle, Venmo, and Cash App are not accepted. Foxhole IT Solutions does not accept barter, trade, services in exchange, or credit offsets unless the owner of Foxhole IT Solutions agrees in a signed writing. The client may not deduct or set off any amount from an invoice unless Foxhole IT Solutions agrees in writing.
Sales Tax
Florida sales tax and any applicable county surtax are added to all taxable charges at the rate in effect when the invoice is issued. When Foxhole IT Solutions furnishes parts for a repair, the entire repair charge, including labor, is taxable. Service that is labor only, with no parts furnished, is not taxed. The rate is 6% state sales tax plus the county discretionary sales surtax that applies where the item is delivered or the service is performed. In Pinellas County the surtax is currently 1%, so the total is 7%. The county surtax applies only to the first $5,000 of a single item. A Business Client that provides a valid exemption certificate before the invoice is issued is not charged tax on the items it covers.
Late Payments
A balance that is unpaid after its due date is charged a late fee of 1% per month on the unpaid balance. For an Individual Customer, the late fee applies to any invoice unpaid 15 days after the invoice date. For a Business Client, the due date is stated in Part 3. The client also pays the reasonable costs of collecting an unpaid balance, and Section 16 governs attorney's fees if a legal action is needed. While an invoice is overdue, Foxhole IT Solutions may pause new service and require payment in advance for further work until the account is current.
Chargebacks
If the client has a concern about a charge, please contact Foxhole IT Solutions first so it can be reviewed and corrected promptly. Nothing in these policies limits a client's rights with its card issuer under the law or the card network's rules.
Billing Disputes
A client who believes they were incorrectly charged, for example billed more than the authorized estimate or charged twice, should notify Foxhole IT Solutions by phone or email within 7 days. Part 2 and Part 3 state when the 7 days begin. Foxhole IT Solutions reviews and responds within 5 business days of notice. This window covers billing disputes only and does not limit rights the client has under the law or card network rules. Complaints about the quality of the work are covered by the warranty in Section 10, and any other disputes are handled under Section 16.
5. Refunds & Cancellations
Completed Work
Refunds are not issued for completed work that was performed as described and authorized. If there is a problem with a repair, Foxhole IT Solutions re-repairs it under the warranty in Section 10. If Foxhole IT Solutions cannot resolve the same defect after a warranty re-repair, the labor charge for that repair is refunded. Parts are refunded only when the part itself was defective and can be returned to the supplier. A refund request for a repair that could not be corrected must be made within the 60-day warranty period.
High-Risk Work
The refund provisions above do not apply to water damage treatment, data recovery, RAID or storage array work, board-level repair, or other high-risk work described in Section 11. That work is billed for the time spent as stated there, and any deposit is applied to that charge. No refund is issued for these services where a good-faith effort was made, regardless of outcome. Foxhole IT Solutions does not bill more than the hours the client authorized in writing without the client's approval, and it tells the client promptly if recovery or repair looks unlikely to succeed so the client can choose to stop the work (Section 11).
Work That Cannot Be Completed
If work cannot be completed due to limitations beyond our control, the client is charged only for diagnostic work actually performed and for any special-order parts already purchased. Any deposit paid is applied to those charges and the remainder is refunded.
Cancellations
If the client cancels before parts are ordered and before work begins, the deposit is refunded in full if the diagnostic fee has already been paid. If it has not been paid, the diagnostic fee is deducted from the deposit and the remainder is refunded. After parts are ordered or work begins, the deposit is applied to the charges actually incurred and is not forfeited as a penalty. If the client cancels after work has begun, the client is charged for the time worked, the diagnostic fee, parts ordered or used, and any travel fee, any remainder of the deposit is refunded within 14 days, and the device is returned as far along as the work reached. Parts special-ordered for the client that cannot be returned are billed at cost. Website project cancellations are covered in Section 24.
Refund Method and Timing
Refunds are issued to the original payment method. Cash payments are refunded in cash. Card refunds are processed promptly and typically appear within 5 to 10 business days, depending on the client's bank.
6. Turnaround, Scheduling & On-Site Visits
Turnaround
Most standard repairs are estimated to be completed within 24 to 48 hours from authorization and receipt of any required deposit, not from pickup or the first inquiry. Foxhole IT Solutions is a single-technician business and is closed on Friday and Saturday, so a repair authorized late in the week may take longer. Parts availability, the complexity of the work, current volume, security locks that have not been disabled, and delays in approval or access can also extend turnaround. All turnaround times are estimates and are not guaranteed, and Foxhole IT Solutions is not liable for a repair taking longer than estimated (Section 12). The client is notified by text or email when the device is ready for delivery, and is given an updated completion date if a repair is expected to exceed the estimate. Rush or expedited service may be available on request, subject to availability, and is billed under Section 3.
Where Service Is Performed
Foxhole IT Solutions works by appointment only. There is no storefront, walk-in location, or drop-off point. Foxhole IT Solutions does not schedule appointments or perform work on Friday or Saturday. Simple repairs are completed in the Foxhole IT Solutions service vehicle during the appointment, and work for a Business Client is usually done on site at its premises. If a repair is too complex or would take too long to finish during the visit, Foxhole IT Solutions picks up the device, completes the repair in the vehicle or at the office, and delivers it back.
Homes and Home-Based Businesses
Foxhole IT Solutions does not enter a residence except with prior approval from the owner of Foxhole IT Solutions. A business that operates from a residence is treated as work inside a home. Any approved visit inside a home is recorded under Section 14. Otherwise, the work is done in the vehicle or the device is picked up for repair at the office.
Service Area and Travel Fee
Mobile service is currently available only in Pinellas County, Florida, and Foxhole IT Solutions does not book appointments outside it. The standard service area is within 25 miles of the primary service location, with no travel fee. Contact Foxhole IT Solutions before booking to confirm service area availability. Beyond 25 miles, a travel fee is charged in tiers: $15 for up to 5 miles past the 25-mile line (25 to 30 miles) and $35 for 5 to 15 miles past it (30 to 40 miles). Any applicable travel fee is disclosed at the time of scheduling and before the appointment. One travel fee covers a pickup and the delivery of the same repair. Each additional trip caused by an unpaid balance, a missed handoff, or a rescheduled delivery is charged again. The $25.00 redelivery fee applies to every repeated delivery, including inside the standard service area.
Availability, No-Show, and Missed Delivery Fees
An authorized person must be present and available at the agreed location for the full duration of the scheduled appointment. If a technician arrives at the scheduled time and no one is available or responsive for 15 minutes, the appointment may be cancelled. A no-show fee of $50.00 for Individual Customers or $75.00 for Business Clients is charged for any missed appointment and for any cancellation made with less than 4 hours' advance notice. A fixed $25.00 missed delivery fee is also charged when Foxhole IT Solutions arrives with a device at the agreed delivery time and no one is available to receive it, and it is charged for each missed delivery. These fees and the redelivery fee must be paid before another appointment or delivery is scheduled.
Rescheduling
A pickup, delivery, or appointment may be rescheduled or cancelled by phone call, text message, or email, free of charge with at least 4 hours' advance notice. A reschedule requested with less than 4 hours' advance notice is treated as a cancellation, and the no-show fee in this Section applies.
Appointment Time and Overtime
Each appointment is booked for a stated time window, which is confirmed at scheduling. If the visit runs past the end of that window, the extra time is overtime. Overtime is billed at the labor rate in Section 25 in 30-minute increments, and any part of an increment is rounded up to the next increment. Overtime that falls outside business hours on a day Foxhole IT Solutions is open is billed at the after-hours rate (Section 3). Foxhole IT Solutions tells an authorized person before the window ends and continues only with that person's approval. If approval is not given, work stops and the client is charged for the time worked. Overtime does not apply to flat-rate work that is priced in the estimate, unless the extra time results from the client's delay, from items missing under Workspace Requirements, or from added work the client approves. Payment for overtime is due under Section 4.
Workspace Requirements
The client provides a clean, safe, adequately lit, and accessible workspace and has the following ready at the time of service, as applicable:
- Every device involved in the service, with its charger and power cable
- The correct, working cables for the job, such as power, USB, Ethernet, and printer or scanner cables
- For printer and scanner setups: the printer or scanner, a working outlet, ink or toner, and paper
- Network access, including the Wi-Fi name and password, and router or admin access when needed
- The passcodes and account access needed for the work, entered or approved by the client, with security locks disabled
- Installation media, downloads, license keys, or software logins required for the work
- Access to an authorized person who can approve the estimate and any change to it
- A safe place to park and a clear path to the work area
If required items are missing, Foxhole IT Solutions may reschedule the appointment or complete only part of the work, and a new appointment and the travel fee may then apply. Foxhole IT Solutions may also reschedule or decline an appointment if the work environment is unsafe or unsuitable.
7. Pickup, Delivery, Custody & Acceptance
Office Repair, Pickup, and Delivery
When a device is picked up for office repair, it is checked in and inspected at pickup under Section 8, and the service intake form, estimate, authorization, and any required deposit apply. The device is delivered back once the repair is complete and the balance is paid. If no one is available to receive the device at the agreed delivery time, the device is returned to the office, the $25.00 missed delivery fee in Section 6 is charged, and Section 15 applies.
Handoff
Every handoff takes place at the door, in the driveway, at the business premises or front desk, or at the service vehicle parked at the location. Foxhole IT Solutions does not enter a home for a handoff. A device is handed over to Foxhole IT Solutions only by, and delivered back only to, an authorized person. A device is never handed to anyone else or left unattended. Foxhole IT Solutions may ask for a valid photo ID at the handoff and may reschedule if the person present is not an authorized person. A missed handoff is subject to the fees in Section 6.
Care and Risk of Loss
Foxhole IT Solutions takes reasonable care of every device in its custody and keeps devices secured while they are being transported, serviced, or held for delivery. It is responsible for the loss, theft, or damage of a device only while the device is in its custody and only when it results from its negligence. That responsibility is subject to the liability cap in Section 12, and it does not extend to pre-existing damage or to events outside Foxhole IT Solutions' control.
Items Left With the Device
The client should remove SIM cards, memory cards, cases, and accessories before service. Any item left with the device must be listed on the service intake form, and Foxhole IT Solutions is not responsible for unlisted items.
Inspection and Acceptance at Delivery
At the handoff, an authorized person inspects and tests the device with the technician. The inspection covers the screen display and touch response, cameras, speakers, and microphone, charging and ports, buttons, Wi-Fi, Bluetooth, and cellular features, and the specific issue that was repaired, as each applies to the device. The client then accepts the device by confirming on the service intake form or the invoice. Accepting the device confirms that the client has inspected it, found no visible damage or defect other than what was documented, and confirmed that it is the same device that was picked up.
Reporting Visible Damage or Missing Items
Please report visible damage, cosmetic issues, and missing items or accessories at the handoff, or within 48 hours after it, in writing by text or email with photos, so Foxhole IT Solutions can inspect the device while the evidence is fresh. Reports made later are still reviewed, but may be harder to verify. Nothing in this section shortens the 60-day warranty on workmanship in Section 10 or the time the client has to bring a legal claim under Florida law.
Post-Repair Care
After a repair, adhesives need about 24 hours to cure. During that time and afterward, the client should avoid pressure, bending, heat, and moisture on the device, especially on a repaired screen or back glass, and should not remove the warranty seal. Foxhole IT Solutions gives these instructions at delivery. Damage from not following them is not covered (Section 10).
8. Device Inspection & Pre-Existing Condition
Intake Inspection
Foxhole IT Solutions inspects each device at intake and records its visible condition, including cracked screens, missing screws, dents, liquid damage indicators, and broken ports, along with its serial number or IMEI. It photographs the device. The client reviews and acknowledges the condition report by signing or checking the acknowledgment on the service intake form, which confirms that the documented condition accurately reflects the state of the device before service. At delivery, the client confirms that it is the same device (Section 7).
Pre-Existing Damage
Foxhole IT Solutions is not liable for any pre-existing damage, defect, or condition present in a device before service, whether it was documented at intake or was reasonably discoverable then. This includes failures of parts weakened by earlier damage, such as a previously cracked screen that breaks further during removal, a swollen battery, or a board corroded by earlier liquid exposure. By handing over a device, the client acknowledges and agrees to this. This section is the single controlling policy on pre-existing damage.
Damage Discovered During Repair
If additional damage is discovered during the work that was not visible at intake, the client is notified immediately, and no further work proceeds until an authorized person authorizes it.
9. Data, Backups & Privacy
Backups and Data Loss
The client is responsible for backing up its data, files, photos, contacts, and information before handing over a device or starting a service, and Foxhole IT Solutions strongly recommends a full backup before any work begins. Before any repair that carries a risk to data, Foxhole IT Solutions offers to make a backup. If the client declines, Foxhole IT Solutions notes that in writing on the work order. Foxhole IT Solutions is not responsible for data lost during a repair that the client declined to back up first, including loss due to hardware failure, operating system reinstallation, factory resets, or unforeseen complications, except as stated in Section 12. See also Section 12.
Data Access and Copying
Foxhole IT Solutions technicians access client data only to the extent necessary to diagnose and complete the requested work, and data is never copied unless an authorized person has authorized it for a specific service. Authorized copying includes data recovery, storage upgrades and drive cloning, operating system repair, reinstallation, or upgrade where files must be preserved, migration to a new device, a backup made at the client's request, virus or malware removal where files must be preserved, and diagnostic imaging of a failing drive. Client data is never sold or shared with a third party, except where the law requires disclosure, such as a court order or a legal duty to report illegal content. The payment, invoicing, scheduling, and cloud service providers Foxhole IT Solutions uses to run its business receive only contact and billing information, never the contents of a device.
Deletion of Copied Data
Once data has been recovered or transferred and is back on the client's devices or systems, all copies held by Foxhole IT Solutions are deleted immediately. The client should verify its data when it is returned, because deleted copies cannot be restored. If a device is considered abandoned, copies are deleted as stated in Section 15. No client data is stored after service is complete unless the client requests it in writing and agrees to pay storage fees quoted in writing before storage begins. Stored data is deleted when the client asks for its deletion or retrieves it, and if storage fees go unpaid, Foxhole IT Solutions may delete the stored data after written notice.
Erase and Reset Requests
When the client asks Foxhole IT Solutions to erase, reset, or reinstall a device, the result is permanent. The client confirms that its data is backed up or no longer needed, and Foxhole IT Solutions is not responsible for data lost because of the request.
Regulated and Privileged Data
Foxhole IT Solutions does not handle protected health information governed by HIPAA, payment card data governed by PCI DSS, or other regulated or privileged data, such as client financial records, legally privileged material, and data covered by other laws or contracts that require special safeguards. It does not provide monitoring or maintenance for systems that store or process that kind of data. The client must remove that data from a device before service or use a provider set up to handle it. Foxhole IT Solutions is not responsible for any compliance obligation or consequence arising from that kind of data left on a device or system submitted for service.
Security Incidents
Foxhole IT Solutions is not an incident response or forensic provider unless the estimate says so in writing. If the client suspects a breach, ransomware, or another security incident, it should contact Foxhole IT Solutions and, for a Business Client, its own insurer and counsel right away. The client is responsible for deciding whether it must notify others or law enforcement and for making any legally required notice. Foxhole IT Solutions will describe the work it performed on request.
Privacy and Breach Notification
All client information, including names, contact details, device information, and service history, is kept confidential and is used only to provide services, bill for them, schedule appointments, keep required records, and run the business. It is never sold. It is shared only with the payment, invoicing, scheduling, and cloud service providers named above, only to the extent needed, and where the law requires it. Foxhole IT Solutions uses reasonable safeguards to protect client information and any data in its possession. Client data is accessed only as needed for the work, client passwords are not kept after the job, and devices are securely erased before recycling or disposal. If a security breach involving personal information occurs, Foxhole IT Solutions will notify affected clients within 30 days after discovering it, as Florida law requires (Fla. Stat. § 501.171), and will tell them what was affected and what steps to take.
Accounts and Credentials
The client enters its own passwords and completes its own sign-ins, including for email, cloud, financial, and password manager accounts. Foxhole IT Solutions does not record or keep passwords or passcodes, never asks for a password manager's master password, never asks anyone to log in to a bank or financial account during service, and never asks for or accepts gift cards, wire transfers, or cryptocurrency as payment. The client should change any password it shares for service. Antivirus, VPN, password manager, backup, and cloud services are provided by third parties under their own terms. The client is the account holder and is responsible for the provider's fees and renewals, including automatic renewals, and for accepting the provider's terms. Foxhole IT Solutions configures these services but does not control the provider and does not guarantee that a product will prevent infection, loss, or unauthorized access.
10. Warranty
Foxhole IT Solutions stands behind the quality of its work. This warranty covers workmanship only. Billing disputes are handled under Section 4.
Warranty Coverage
All labor performed by Foxhole IT Solutions is warranted for 60 days from the date of service completion. Parts supplied and installed by Foxhole IT Solutions are covered for 60 days from the date of installation. If the same issue recurs within the warranty period, the device is re-evaluated and repaired at no additional labor charge. Setup, configuration, and support work is covered for the work performed, and later changes made by others and any new software or hardware added afterward are not covered. Repair or replacement of the affected part or labor is the client's sole remedy under this warranty, except as stated in Section 5.
Glass, Screen, and Back Glass Repairs
These repairs are covered only against defects found at the time of installation, such as a dead pixel, a defective touch response, a poor fit, or a part that was defective when installed. They are not covered against any new impact, pressure, bending, or liquid exposure, however minor.
Requirements, Seals, and Claims
To be eligible for warranty service, the client must provide proof of service, such as the invoice or service order number, present the original device that was repaired, and submit the claim within the 60-day warranty period. Foxhole IT Solutions applies a tamper-evident warranty seal to each repaired device where its design allows, and the client must not remove, break, cover, or alter it. A missing, broken, or altered seal voids the warranty. To submit a claim, the client sends an email to tyler@foxholeitsolutions.com with its name, the invoice or service order number, a description of the problem, and photos or video. Foxhole IT Solutions responds within 5 business days, inspects the device through the pickup and delivery process in Section 7, and decides whether the issue is covered. Warranty repairs must be performed by Foxhole IT Solutions, and costs of third-party repair services are not reimbursed.
Void Conditions and Exclusions
The warranty is void if a seal or similar marking has been removed, damaged, or altered, if the device has suffered new damage after it was returned, including drops, impacts, crushing, bending, or liquid, moisture, or heat exposure, or if the device has been opened, modified, or serviced by anyone else after the original repair.
The warranty does not cover:
- Issues unrelated to the original repair
- Damage caused by software, viruses, or unauthorized modifications after service, including jailbreaking, rooting, or unofficial firmware
- Parts not supplied by Foxhole IT Solutions, including client-supplied parts
- Normal wear and tear, cosmetic scratches, and gradual battery capacity loss
- Damage from misuse, from non-compliant chargers or accessories, or from improperly installed cases or screen protectors
- Loss of data
- Devices that were water-damaged or previously opened or repaired by another technician before the original repair, except as stated in the written estimate
This warranty applies only to the original client and cannot be transferred.
Warranty Pickup and Delivery
Warranty service follows the same pickup and delivery process as any other repair. The travel fee for warranty pickup and delivery is waived only if Foxhole IT Solutions determines that the defect was caused by the technician's workmanship. If the issue is not covered, or was not caused by the technician, the standard diagnostic, labor, and travel fees apply. A defective part is treated as a manufacturer defect rather than the technician's fault, and the part and labor remain covered, but the travel fee still applies.
Duration of Implied Warranties
The warranty in this section is the only written warranty on repairs and services. ANY IMPLIED WARRANTY ON PARTS SUPPLIED BY FOXHOLE IT SOLUTIONS OR ON ITS LABOR, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, LASTS ONLY FOR THE SAME 60 DAYS. Some states do not allow limits on how long an implied warranty lasts, so this limit may not apply to the client. This warranty gives the client specific legal rights, and the client may have other rights that vary by state.
11. Repair Disclosures & High-Risk Work
Manufacturer Warranty and Coverage
Foxhole IT Solutions is not the manufacturer. Some manufacturers, extended coverage providers such as AppleCare, carriers, and insurers may decline coverage for damage they trace to a repair, so the client should check its coverage terms before authorizing a repair on a device that is still covered. Foxhole IT Solutions makes no promise about manufacturer, carrier, or insurance coverage. Foxhole IT Solutions is an independent repair and IT service provider. It is not affiliated with, authorized by, or endorsed by Apple, Samsung, Google, Microsoft, or any other manufacturer, carrier, or brand. Brand names are used only to identify the devices and parts being serviced.
Water and Dust Resistance
Factory water and dust resistance is not restored by any repair, especially screen, back glass, battery, and port repairs. After a repair, the device should be treated as not water resistant.
Features and System Messages
Aftermarket and non-OEM parts can change display color or brightness, True Tone, Face ID or Touch ID, battery health reporting, or cause an unknown-part message on the device. Foxhole IT Solutions will tell the client when a recommended part carries this risk before the repair is authorized.
High-Risk Work Authorization
Before data recovery, RAID or storage array work, server work, and any other work that risks further data loss or hardware failure, Foxhole IT Solutions obtains the authorization of an authorized person in writing, and a text or email counts. The authorization states the hourly rate, the estimated hours, and the risks. Those risks include that a degraded or failing drive can fail further when it is accessed, that power or hardware faults can interrupt the work, and that some data may be unrecoverable. Time spent is billed under Hourly Billing in Section 3, even if recovery is only partial. Foxhole IT Solutions does not bill more than the hours the client authorized in writing without the client's approval, and it contacts the client before continuing if the work is approaching the authorized hours. If recovery or repair looks unlikely to succeed, Foxhole IT Solutions tells the client promptly so the client can choose to stop the work. Time already worked is billed at the authorized rate.
Data Recovery
Data recovery begins with an evaluation, and the diagnostic fee applies and is credited toward the recovery if the client approves it. Recovered data is returned on a storage drive the client supplies, or on a drive sold by Foxhole IT Solutions at a price stated in the estimate. The client confirms that it owns the data or has the right to recover it and authorizes the copying needed to do so (Section 9). Foxhole IT Solutions tells the client what was recovered. Partial recovery counts as performed. Drives may need to be opened or disassembled, and the manufacturer may decline warranty coverage as a result. Foxhole IT Solutions does not provide clean-room recovery. If a specialist lab is needed, the client may choose one, and Foxhole IT Solutions will not send a device or its data to any lab without the client's written approval.
Water Damage and Component-Level Repair
Water damage treatment, board-level repair, and micro-soldering involve delicate parts, carry a risk of further damage, including loss of the device, and are performed on a best-effort basis. Component-level repairs include charging port, HDMI port, and camera repairs. Foxhole IT Solutions makes no guarantee, warranty, or representation that any device will be restored to full or partial working condition or that any data will be recovered, and paying the service fee does not guarantee a successful result. No refund is issued for these services where a good-faith effort was made, regardless of outcome, and the diagnostic fee remains due when a repair cannot be completed.
Security and Malware Services
Malware removal and security work reduce risk, but no service can guarantee that a device is free of threats or protected from future infection, hacking, or data theft. Foxhole IT Solutions is not responsible for infections, breaches, or losses that occur after service. Some infections require reinstalling the operating system, which can erase data. The client is responsible for keeping software updated, keeping backups, and using its devices safely.
Unlock Services
Unlock services mean carrier or network unlock requests and passcode assistance for the verified owner of a device. Foxhole IT Solutions requires proof of ownership. It does not remove Activation Lock, iCloud locks, Google Factory Reset Protection, or device management locks unless the client provides the owner's credentials or the lock holder's release, and it refuses any unlock that is inconsistent with proven ownership. Unlock results depend on the carrier or manufacturer, and Foxhole IT Solutions does not guarantee that an unlock will succeed.
Battery and Hazard Handling
If a device has a swollen, damaged, or overheating battery or another safety hazard, Foxhole IT Solutions may isolate the device, remove the battery or part, and dispose of it safely. The client authorizes this, Foxhole IT Solutions is not responsible for damage to the device that results from handling the hazard, and a handling fee disclosed in the estimate may apply. Damaged or swollen lithium batteries are kept in a fire-safe container and taken to a recycler within 30 days.
Advice and Network Changes
Recommendations from Foxhole IT Solutions are not guarantees and are not legal, insurance, or regulatory compliance advice. Changes to routers, networks, and servers can briefly interrupt service. Foxhole IT Solutions schedules planned changes with the client and is not responsible for the interruption that a planned change causes.
12. Limitation of Liability & Indemnification
Limit of Liability (Please Read Carefully)
To the fullest extent permitted by applicable law, Foxhole IT Solutions' total liability to any client for any claim arising out of or related to services rendered, INCLUDING CLAIMS BASED ON FOXHOLE IT SOLUTIONS' OWN NEGLIGENCE, shall not exceed the total amount paid by the client for the specific service giving rise to the claim. The one exception is loss, theft, or damage of a device while it is in the custody of Foxhole IT Solutions (Section 7), for which liability is limited to the fair market value of the device at the time it was received for service. For subscription services, the amount paid for the specific service means the fees paid for the month in which the claim arose. This limit does not apply to bodily injury or death, gross negligence, intentional misconduct or fraud, or any liability that Florida or federal law does not allow to be limited.
Excluded Damages
Foxhole IT Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages of any kind, including but not limited to loss of data, loss of revenue, loss of business, downtime, or loss of use, regardless of the form of action or the basis of the claim, even if Foxhole IT Solutions has been advised of the possibility of such damages.
Pre-Existing Damage
Liability for pre-existing damage, defects, and conditions is governed by Section 8.
Assumption of Risk
Repair, water damage treatment, component-level repair, data recovery, unlocking, server work, and software work carry inherent risks even when done with reasonable care. These include that a device may fail to power on, lose data, lose features, or be damaged further, and that an old or damaged part may break during removal. By accepting these policies, the client acknowledges and accepts those risks and releases Foxhole IT Solutions from claims for loss that results from the inherent risks themselves. This release does not cover loss caused by gross negligence or intentional misconduct.
Insurance
Foxhole IT Solutions is not the client's insurer. The client should insure its own devices, data, and operations. Foxhole IT Solutions' responsibility for a device is limited as stated in this section and in Section 7. On request, Foxhole IT Solutions provides an itemized invoice or a written repair statement for an insurance or warranty claim. It does not file claims or deal with insurers for the client unless agreed in writing, and an insurer's decision does not change the amount owed.
Indemnification
The client agrees to indemnify and hold harmless Foxhole IT Solutions, Gulf Tech Solutions LLC, and its technicians from claims, losses, and reasonable attorney's fees that arise from:
- A false statement about ownership or authority to service a device
- A device that is stolen or was obtained unlawfully
- Illegal content or unlicensed software on a device
- The client's unsafe premises or conduct
- The client's breach of these policies
Protection for Foxhole IT Solutions and Its Technicians
Everything in these policies that limits liability, disclaims a warranty, or releases a claim applies to Foxhole IT Solutions, Gulf Tech Solutions LLC, and its owner, technicians, employees, and subcontractors, and each of them may rely on those terms. To the extent the law allows, a claim arising from services is made against Gulf Tech Solutions LLC and not against its owner, technicians, employees, or subcontractors individually. The liability cap in this section applies to all of them together and is not increased by naming more than one.
13. Refusal of Service, Safety & Conduct
Right to Refuse Service
Foxhole IT Solutions reserves the right to refuse, decline, or discontinue service at any time and for any reason deemed necessary by the technician or business owner, to protect the safety, integrity, and legal standing of the business and its staff. This includes the following circumstances:
- The requested work involves illegal modifications, software, or activities, or is unsafe, or is outside the scope of services offered
- The device presents a safety hazard such as a swollen battery, severe liquid damage, or exposed electrical components
- Anyone present is abusive, threatening, harassing, or disrespectful toward the technician or staff
- The device is suspected to be stolen or otherwise obtained unlawfully
- Ownership or authorization cannot be reasonably established, or the client cannot or will not provide the ownership attestation or ID described in Section 2
- The client will not disable Find My, Activation Lock, FRP, or similar locks, or will not unlock the device or provide the credentials needed to test it
- Completing the work would require bypassing security features in a manner inconsistent with the client's proven ownership of the device
- The client has an unpaid balance, has filed a chargeback that was decided in favor of Foxhole IT Solutions, or has repeatedly missed appointments or deliveries
Charges Upon Refusal
If service is refused before any work is performed, no charges apply, except the diagnostic fee if the assessment has already been performed, and any deposit is refunded in full. If service is discontinued after work has begun, the client is charged for labor and parts used up to that point and for any diagnostic and travel fees that apply. Any deposit paid is applied to those charges, and the remainder is refunded. Payment is due before the device is returned.
No Discrimination
Foxhole IT Solutions does not refuse service on the basis of race, color, religion, sex, national origin, disability, age, or any other protected characteristic. Refusal of service is based solely on the nature of the request or the conduct of the client as outlined above.
Technician Safety
The technician may leave immediately and end the service if a weapon is displayed or threatened, if anyone present appears intoxicated or impaired, if anyone is threatening, harassing, or discriminatory toward the technician, if animals are not secured, or if the work area is unsafe. Fees for work completed and any applicable travel fee remain due. The technician is never required to enter a residence, a vehicle, or a private area.
Client Premises and Information
Before a visit, the client secures pets, valuables, cash, confidential records, and fragile items, and tells the technician about any known hazards. Foxhole IT Solutions is not responsible for the pre-existing condition of the premises, wiring, network, or equipment, or for items left unsecured. It is responsible for damage to the premises only when it is caused by its negligence, and that responsibility is subject to Section 12. Foxhole IT Solutions does not perform electrical work, structural changes, network or low-voltage cabling, or the installation of security cameras, alarm systems, or access control equipment, and work that requires a licensed contractor is the client's responsibility. The client is responsible for the accuracy of what it tells Foxhole IT Solutions about ownership, the history of the device, prior repairs, and the problem, and Foxhole IT Solutions relies on that information.
Technician Focus
Repair work needs focus. It involves small components, lithium batteries, and delicate data. The technician may ask anyone present to step back, stop interrupting, stop touching the device, tools, or work area, or leave the technician alone while work is in progress, and the client agrees to comply. This includes hovering over the work, repeated questions or conversation during critical steps, phone calls or other interruptions, and interference by children, pets, or other people present. Clients and their people are welcome to ask questions before the work begins, at natural pauses, and when the work is complete, and may observe from a reasonable distance when the technician agrees. They may not enter the service vehicle or the technician's work area without the technician's permission.
Stopping or Pausing Work
Foxhole IT Solutions may pause or stop work at any time if the client, or anyone with the client, distracts the technician, interferes with the work, or behaves in a way the technician considers unsafe, abusive, or threatening. If work is stopped, the client is charged for the time and work completed up to the point it stopped, even if the repair was not finished, including labor at the hourly rate in Section 25, the diagnostic fee if not already applied, parts used or ordered, and any applicable travel fee. Any deposit paid is applied to these charges and the remainder is refunded. Payment is due before the device is returned. Foxhole IT Solutions makes the device safe and, where practical, returns it in the condition found or as far along as the work reached. A repair that is stopped partway may leave the device not fully working, and Foxhole IT Solutions is not responsible for that condition when the stoppage was caused by interference. If the client wants the work finished, Foxhole IT Solutions may require a new estimate and a new appointment, and a deposit under Section 4 may apply.
14. Photos, Video & Recording
Photos and Video of Devices
Foxhole IT Solutions may photograph and video a device at intake, during the work, and on completion. By handing over a device, the client consents to the uses described here. Photos and videos are used for internal documentation of the condition of the device at each stage, are kept for at least 90 days after service completion, are deleted as stated in Section 17, and may be used to resolve a dispute about device condition. They may also be used on social media, on the Foxhole IT Solutions website, and in advertising, for example to show a repair before and after. Only the device itself may appear. No client data is ever used, which means no names, contact details, passwords, accounts, messages, personal files or photos, screen contents, serial numbers or IMEI numbers, addresses, or images of people, and anything identifying is removed or covered before a photo or video is posted. A client who does not want their devices shown may opt out by marking the opt-out box on the service intake form, and documentation use stays in place. Other than that use, photos and videos are not shared publicly or with any third party without the client's explicit written consent, except where the law requires disclosure.
Recording in the Vehicle, Workspace, and Visits
Video recording, without audio, is in use in the Foxhole IT Solutions service vehicle and at its office workspace, and may be in use during service at the client's premises or another approved location, for technician safety and to keep an accurate record of the work. Foxhole IT Solutions does not record audio of conversations. By completing the service intake form, the client consents to this video recording for itself and for its employees and anyone else it brings or authorizes to be present, and the client is responsible for telling those people. At any location other than the vehicle and office, the technician announces the recording at the start of the visit. Recordings are kept for at least 90 days, are deleted as stated in Section 17, and are used only for safety and to resolve disputes. They are not shared publicly or with a third party except as required by law, to resolve a dispute under Section 16, or with the secure storage provider that holds the recordings, which may not use them for any other purpose. Clients and their people may not record the technician or the repair work without the technician's consent, except where the law allows, and Foxhole IT Solutions may stop work that is being recorded without consent.
Remote support sessions are recorded only if Foxhole IT Solutions tells the client before the session starts and the client agrees. A client may ask at any time that a session not be recorded, and Foxhole IT Solutions will stop or will not start the recording.
Recorded Visits Inside a Home
Every approved visit inside a home is recorded on video, without audio, from arrival to departure. The recording protects the technician's safety and gives both sides an accurate, time-stamped record of the visit: the condition of the work area, the devices handled, and the property in view before, during, and after the work. The client is told about the recording when the visit is approved and must consent to it before the technician enters, and the client is responsible for informing anyone else in the home. If the client declines, the technician will not enter, and the repair is done in the vehicle or at the office instead. The technician works only in the agreed work area, and recording is limited to that area and the technician's activity.
15. Device Abandonment
This section is the single controlling policy on unclaimed and abandoned devices. It applies to every reference to unclaimed devices elsewhere in these policies.
Disclosure Before Work
The service intake form and every estimate state the 30-day abandonment period in this section. Before any work begins, the client acknowledges it by checking a separate box on the intake form. Foxhole IT Solutions does not begin work on a device until that box is checked. The acknowledgment is required for any device picked up for office repair or otherwise leaving the client's sight. A repair completed in the vehicle during the visit needs only the standard intake form.
Mailing Address
The client provides a mailing address on the service intake form, in addition to a phone number and email address.
When a Device Is Considered Abandoned
A device is considered abandoned if the client has not accepted delivery or arranged a delivery time within 30 calendar days of being notified that the repair is complete, or within 30 calendar days of a repair estimate being provided with no response from the client. A device held for an unpaid balance is subject to this section.
Estimate Notices
The abandonment period and the storage fee run only from the date a completion notice or estimate notice is sent by text or email. A verbal estimate does not start either one, so the written notice is sent right after the estimate is given.
Expired Estimates
An estimate expires after 14 days under Section 3, but the abandonment period runs from the day the estimate notice is sent. An expired estimate does not pause or restart it, and a new estimate is needed before work proceeds.
Declined Estimates
When a client declines an estimate, the device is returned as found under Section 3. The notice that the device is ready for return is the Day 0 notice under this section.
Unpaid Deposits
A device waiting on a required deposit is treated as waiting on an unanswered estimate, counted from the date the deposit invoice is sent.
Missed Deliveries
A scheduled delivery that is missed, cancelled, or rescheduled does not pause or restart any period in this section. A delivery time that was arranged but not completed does not count as accepting delivery or arranging a delivery time.
Notice Requirements
Foxhole IT Solutions sends notices by text or email to the contact details on the service intake form. It sends a completion notice or estimate notice on Day 0. It sends a reminder on Day 7 that states the storage fee of $5.00 per day beginning on day 8 and the abandonment date, which is Day 30, or Day 45 if there is no mailing address. It sends a final notice on Day 10 by certified mail to the mailing address on the intake form, with a text or email and a phone call attempt. That notice describes the device, states the balance and storage fees owed, states that the device will be considered abandoned on Day 30 and may then be disposed of, and gives the client at least 15 days from the mailing date to claim the device. It sends a reminder on Day 22 that states the balance and storage fees owed to date, and a closing notice by text or email, with a phone call attempt, on Day 30. Disposal may proceed once the Day 10 certified-mail notice and the Day 30 closing notice are documented. The client is responsible for keeping contact details current. Each attempt is documented with its date, method, and result, and a voicemail, text, or email counts as an attempt. The certified-mail receipt is kept with the record.
No Mailing Address
If the client did not provide a mailing address, or the certified mailing is returned undeliverable, the final notice is sent by text and email with a phone call attempt, and the device is considered abandoned on Day 45 instead of Day 30. A closing notice is then sent by text or email, with a phone call attempt, on Day 45, and disposal may proceed once it is documented.
Closed Days
If a date in this section falls on a day Foxhole IT Solutions is closed, the date moves to the next business day.
Devices on Hold
A device held for suspected theft (Section 13), at the request of law enforcement, or because ownership is disputed is not subject to disposal under this section until the hold ends. Storage fees are suspended during a hold requested by law enforcement.
Storage Fee
If delivery of a completed device has not been accepted or scheduled within 7 calendar days of the completion notification, or if a device is waiting on an estimate that the client has not answered within 7 calendar days of the estimate notice, a storage fee of $5.00 per day is charged starting on day 8. The notice states that start date and the amount. The fee continues until the device is delivered and the outstanding balance, including all storage fees, is paid in full. Total storage fees never exceed the fair market value of the device at the time it was received for service. For a device waiting on an unanswered estimate, the day 7 reminder states the $5.00 daily rate, the day 8 start date, and the abandonment date. Foxhole IT Solutions may waive storage fees at its discretion.
Reclaiming a Device
A client who contacts Foxhole IT Solutions and pays the amounts owed before the device is disposed of may reclaim it.
Disposal of Abandoned Devices
Once a device is considered abandoned and the notices required by this section are documented, Foxhole IT Solutions may securely erase and then recycle or donate the device, or destroy it if it cannot be recycled or donated. The client authorizes this disposal by acknowledging the abandonment period on the service intake form. Foxhole IT Solutions may keep any payment received from recycling the device, up to the amount needed to recover the outstanding service fees, storage fees, certified mail costs, and other costs incurred. Any deposit paid is applied to those amounts first. If a recycling payment is more than the amounts owed, the excess is held for the client for at least 12 months and paid to the client on request. If it is not claimed, Foxhole IT Solutions handles it as unclaimed property under Florida law (Chapter 717, Florida Statutes). Client data on the device is securely erased before the device is destroyed, recycled, or donated. The client waives all claims to the device after the abandonment period has elapsed and the required notice has been given. Disposal under this section is not a loss or damage of a device under Sections 12 and 7.
Copied Data
Data copied or recovered from a device is securely deleted when the device is considered abandoned, unless the client has a written storage agreement under Section 9.
Items Left With the Device
Items left with a device and listed on the intake form are returned with it or disposed of under the same notice. Items that were not listed are disposed of with the device.
Certified Mail Costs
The actual cost of certified mail is added to the amount owed.
16. Dispute Resolution & Governing Law
In the event of any dispute, claim, or controversy arising out of or relating to services provided by Foxhole IT Solutions, the parties agree to follow the steps below. Billing disputes should first be raised within the 7-day window in Section 4, and workmanship claims are handled under the warranty in Section 10.
Step 1: Direct Communication
The parties first attempt to resolve the dispute through direct communication. If the dispute cannot be resolved informally within 10 business days, the parties move to Step 2.
Step 2: Mediation
Both parties agree to submit the dispute to non-binding mediation before pursuing any other legal remedies. This requirement does not apply when Foxhole IT Solutions is collecting an undisputed unpaid invoice or seeking emergency relief to protect people or property. The mediator's fees are split equally by both parties, and each party pays its own costs and attorney's fees for the mediation.
Step 3: Courts
Any unresolved dispute shall be handled exclusively in the Small Claims Court or courts of competent jurisdiction located in Pinellas County, Florida, or in the federal court for the district that includes Pinellas County. By accepting services from Foxhole IT Solutions, the client consents to this dispute resolution process, to the exclusive jurisdiction of those courts, and to their personal jurisdiction over the client.
Attorney's Fees and Costs
In any legal action arising out of services provided by Foxhole IT Solutions, the prevailing party is entitled to recover its reasonable attorney's fees and court costs.
Governing Law
These policies and any dispute or claim arising out of or in connection with services rendered by Foxhole IT Solutions (Gulf Tech Solutions LLC) are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
17. General Terms
Communications Consent
By providing a phone number or email address, the client consents to calls, text messages, and emails about its service, including estimates, status updates, pickup, delivery, and the notices in Section 15. Message and data rates may apply. The client may reply STOP to opt out of non-service messages and may ask to stop text messages at any time, in which case service notices are sent by email. Foxhole IT Solutions sends promotional messages only to clients that separately agree to receive them.
Notices
A notice to the client is effective when it is sent by text or email to the contact details on the service intake form or the client's account. The certified-mail notice in Section 15 is effective when it is mailed. Unless a section says otherwise, a notice to Foxhole IT Solutions must be sent by email to tyler@foxholeitsolutions.com.
Assignment
The client may not assign or transfer its account or these policies or any right under them without the written consent of Foxhole IT Solutions. Foxhole IT Solutions may assign them to a successor to its business, including a successor to Gulf Tech Solutions LLC.
Survival
The payment terms, the warranty limits, Sections 9, 12, 15, and 16, and any other term that by its nature continues, remain in effect after service ends or an account is closed.
Severability and No Waiver
If any provision of these policies is found unenforceable, the remaining provisions stay in effect. Foxhole IT Solutions' failure to enforce a provision at any time does not waive its right to enforce it later.
Events Outside Our Control
Foxhole IT Solutions is not liable for a delay or failure to perform caused by events beyond its reasonable control, including severe weather and hurricanes, power or internet outages, supplier or shipping delays, parts shortages, vehicle breakdowns, illness or emergencies, and acts of government. Foxhole IT Solutions notifies the client of the delay and gives an updated timeline. If the delay extends beyond 30 calendar days, the client may cancel the work, and Section 5 applies.
Employees and Subcontractors
These policies apply to everyone who works for Foxhole IT Solutions, including employees and subcontractors. Foxhole IT Solutions may use them to perform or support services, and the client's rights and responsibilities under these policies stay the same. Each of them is covered by the protections in Section 12.
If Foxhole IT Solutions Is Unavailable
If the owner of Foxhole IT Solutions is unable to operate the business, a designated representative may return devices, collect payment, and delete copied client data, and will contact clients using the details on their intake forms. Time during which Foxhole IT Solutions could not operate does not count toward the periods in Section 15.
Records
Foxhole IT Solutions keeps service intake forms and their signed acknowledgments, estimates, invoices, communications, abandonment notice logs, and certified-mail receipts for 5 years. Photos and recordings are kept for at least 90 days as stated in Section 14 and are deleted after 1 year unless they are needed for an open dispute or legal claim. Copied client data is deleted as stated in Section 9. Texts and emails are the official record of estimates, approvals, notices, claims, and disputes, and Foxhole IT Solutions may confirm phone conversations by text or email. Foxhole IT Solutions also keeps records of its work in the ordinary course of business, including time logs, photos, videos, and messages, and those records may be used as evidence of the services performed. If a client is represented by an attorney, communications go through the attorney in writing.
Interpretation
Headings are for convenience and do not change the meaning of any provision. All amounts are in US dollars. The word "including" means "including but not limited to." A reference to days means calendar days unless the text says business days.
Client Acknowledgment
By booking a service, handing over a device, approving an estimate, or accepting an agreement, the client acknowledges that it has read, understood, and agreed to all policies that apply to it, including the deposit, payment, warranty, data handling, abandonment, refund, and dispute terms and, for a Business Client, the credit and subscription terms. These policies may change as stated in Section 1. The most current version is available to clients on request.
PART 2. ADDITIONAL TERMS FOR INDIVIDUAL CUSTOMERS
This Part applies to an Individual Customer, in addition to Part 1. In this Part, "customer" means an Individual Customer.
18. Payment, Disputes & Returns for Individual Customers
Payment Due
Payment in full, less any deposit already paid, is due upon completion of the repair and before the device is returned to the customer. The device is not released until the balance is paid. When there is no device to hold, such as on-site setup or work done at the customer's location, payment is due when the service is complete. Payment is accepted only in cash or by card. Foxhole IT Solutions does not offer credit accounts to Individual Customers.
Billing Disputes
The 7-day billing dispute window in Section 4 begins on the date the service is completed. Foxhole IT Solutions reviews and responds within 5 business days of notice.
Right to Cancel a Home Solicitation Sale
Florida law gives a buyer a right to cancel certain sales made at the buyer's home (Fla. Stat. §§ 501.021 to 501.055). A repair or other service that the customer requests in advance is not a home solicitation sale. If Foxhole IT Solutions offers an additional sale of goods or services at the customer's home that the customer did not request in advance, and the customer agrees to it there, the sale is a home solicitation sale. For that sale, Foxhole IT Solutions provides a written agreement that the customer signs, shows the date the customer signs as the transaction date, and includes the following statement under the caption BUYER'S RIGHT TO CANCEL:
"This is a home solicitation sale, and if you do not want the goods or services, you may cancel this agreement by providing written notice to the seller in person, by telegram, or by mail. This notice must indicate that you do not want the goods or services and must be delivered or postmarked before midnight of the third business day after you sign this agreement. If you cancel this agreement, the seller may not keep all or part of any cash down payment."
If the customer cancels, Foxhole IT Solutions returns any payment within 10 days after the cancellation. This statement controls over the deposit and refund terms in Sections 4 and 5 for that sale.
If the customer buys additional goods or services totaling $25 or more during a visit and did not request those items before the visit, the customer may also cancel that purchase within 3 business days under the Federal Trade Commission's Cooling-Off Rule (16 C.F.R. Part 429) by telling Foxhole IT Solutions in writing or by email. Foxhole IT Solutions explains this cancellation right at the time of the sale and sends the customer a written cancellation form when the customer says they want to cancel or asks for one. Using the form is not required, and any written notice that the customer wants to cancel is enough. For this Section and for any cancellation right under Florida or federal law, "business day" means any day except Sunday and federal holidays. Repairs the customer requested before the visit are not covered by this paragraph.
Minors
A customer under 18 cannot authorize service. A parent or legal guardian must complete the intake form and authorize the repair.
Accessory and Product Returns
This applies to items sold by Foxhole IT Solutions, such as cases, screen protectors, chargers, cables, adapters, storage, and other accessories.
- Return window: Items may be returned within 14 calendar days of purchase with the receipt or invoice. Because Foxhole IT Solutions has no storefront, the customer contacts Foxhole IT Solutions to arrange the return, and the item is collected at the next appointment or at an arranged time.
- Unopened and unused: Items in their original, unopened packaging are refunded in full, including sales tax.
- Opened but unused: Items that are opened but unused, complete, and in resalable condition are refunded less a 15% restocking fee.
- Defective items: An item that is defective within 30 days of purchase is replaced at no charge, or refunded with no restocking fee if a replacement is not available. After 30 days, the manufacturer's warranty applies.
- Refund method: Refunds go to the original payment method.
The following items are not returnable: items installed by Foxhole IT Solutions, such as an applied screen protector or a fitted case; used items, and items that are damaged by the customer or missing packaging or parts; special- order and custom items; clearance or final-sale items marked as such at the time of sale; and software, licenses, and gift cards.
19. Home Services & Specialty Devices
In-Home Setup and Support Services
Services such as home Wi-Fi and router setup, mesh and extender setup, smart home setup, printer setup, home network security checks, and senior tech assistance usually require being inside a home. These services are provided only with prior approval from the owner of Foxhole IT Solutions and under the recorded home visit terms in Section 14. Where approval is not given, the service is done at the door where possible, or it is declined.
Senior and Assisted Tech Support
A customer may have a family member or caregiver present during service, and Foxhole IT Solutions welcomes that. Foxhole IT Solutions never asks for or accepts gift cards, wire transfers, or cryptocurrency, and accepts payment only by the methods in Section 4.
Plain-Language Estimates
For every customer, and especially customers age 60 or older, customers with a disability, and veterans and servicemembers, Foxhole IT Solutions explains the estimate out loud before work starts and writes the following on the estimate or work order: the total price, the deposit, the hourly rate and estimated hours, how to cancel, and the warranty period. Foxhole IT Solutions does not start work until the customer has heard this explanation and approved the estimate.
Smart Home Devices and Cameras
Smart home setup depends on the manufacturer's apps, accounts, and cloud services, which Foxhole IT Solutions does not control. The customer is the account holder. Foxhole IT Solutions views a camera or microphone feed only as needed to test a device during setup and does not keep it. It is not responsible for compatibility limits or outages of the manufacturer's services. Setup means configuring the device and its app. Foxhole IT Solutions does not run wiring or install hardwired cameras (Section 13).
Gaming Consoles and Controllers
Console and controller repairs may affect the manufacturer's warranty coverage, so the customer should check the manufacturer's terms before authorizing a repair. Online accounts remain the customer's responsibility. Foxhole IT Solutions does not install modification chips, unauthorized firmware, or pirated software, and does not make any change that violates the manufacturer's terms. Cleaning and thermal paste service reduces heat but does not guarantee that a console will not fail later. Customers should sign out of online accounts and back up saved games before service, and Foxhole IT Solutions is not responsible for lost save data.
PART 3. ADDITIONAL TERMS FOR BUSINESS CLIENTS
This Part applies to a Business Client, in addition to Part 1.
20. Business Accounts, Representatives & Payment
Business Accounts
Every Business Client pays under this Section. Foxhole IT Solutions may, at its discretion, approve a Business Client for a credit account with a credit limit, and may decline, pause, or end an account at any time. Either party may end a business account at any time. Invoices already issued stay due, and the payment terms in this Section apply to later work.
Authorized Representatives
The Business Client names the people authorized to schedule service, approve estimates, and hand over and receive devices. The representative who schedules an appointment completes the service intake form. The Business Client is responsible for all work approved by its authorized representatives and for keeping the list current. The person who accepts these policies for the Business Client confirms that they have authority to bind it. The Business Client may add or remove an authorized representative by a text or email from an existing authorized representative or from an owner or officer, and the change takes effect when Foxhole IT Solutions confirms it. Until then, Foxhole IT Solutions may rely on the existing list. A device that belongs to an employee, a client, a lender, or any other third party is the responsibility of the Business Client, which must have written authority to submit it.
Payment Terms
Payment is due within 15 calendar days of the invoice date for on-site and remote work. A device picked up for repair is released when its balance is paid (Section 4). Payment is accepted in cash, by credit or debit card, or by bank transfer (ACH) through Square. The late fee in Section 4 applies to a balance unpaid after its due date, and a monthly subscription invoice is due on the invoice date (Section 22).
Returned Bank Transfers
If a bank transfer (ACH) or other electronic payment is dishonored or returned unpaid by the Business Client's bank, Foxhole IT Solutions may recover the bank fees it actually incurs plus the service charge Florida law allows under Section 68.065 of the Florida Statutes. Before collecting that charge, Foxhole IT Solutions sends the written demand for payment that the statute requires. The amount owed, any late fee, and the other terms of Section 4 continue to apply.
Credit Accounts and Personal Guarantee
Each approved credit account has a credit limit that is stated when the account is approved, and Foxhole IT Solutions may pause service when unpaid balances reach that limit. An owner or officer of the Business Client personally guarantees the account's unpaid invoices in a separate signed writing, which may be an electronic signature. An account is not approved until that guarantee is signed.
Billing Contact and Purchase Orders
The Business Client names a billing contact and email address for invoices on the service intake form. If it uses purchase orders, it gives the purchase order number before work begins. An invoice is not delayed or changed because a purchase order number was not provided.
Disputed Invoices
The 7-day billing dispute window in Section 4 begins on the invoice date. The undisputed portion of an invoice is still due on time, and Section 16 applies to the dispute.
Remote Overtime and Written Plans
Overtime also applies to a remote session that runs past its booked window. A written plan may waive the diagnostic fee for work outside the plan and may state a different hourly rate for the work it covers.
Vendor Coordination
The Business Client authorizes Foxhole IT Solutions to contact its internet provider, software vendors, manufacturers, and other service providers about the work. The Business Client remains responsible for its own accounts and for any vendor fees, and Foxhole IT Solutions is not responsible for a vendor's delays, errors, or decisions.
21. Remote Support, Servers & Network Equipment
Remote Support
Remote support sessions are provided over a secure remote access tool chosen by Foxhole IT Solutions. An authorized representative or user must be present for the whole session, approve the connection, and have a stable internet connection. The technician accesses only what is needed for the requested work. Access ends when the session ends, and Foxhole IT Solutions does not leave remote access software or credentials in place unless the Business Client asks for it in writing. Remote sessions are billed under Hourly Billing in Section 3, with no travel fee, and payment is due under Section 20. Remote support is limited to what can be done without physical access to the device, and Foxhole IT Solutions may end a session and recommend an in-person visit, in which case the time used is billable.
Servers and Network Equipment
Foxhole IT Solutions services servers, network storage, switches, routers, and similar equipment on site or remotely. It configures this equipment but does not run or install cabling or wiring, or install security cameras or access control equipment (Section 13). Before work, the Business Client provides the administrator credentials and the current configuration and confirms that backups are current. Changes can interrupt service, and planned downtime is scheduled with the Business Client. Work outside business hours is billed at the after-hours rate in Section 3. Servers, network storage, switches, routers, and similar equipment stay at the Business Client's premises. Foxhole IT Solutions does not pick up, hold, or store them, so the lien in Section 4 and the abandonment terms in Section 15 do not apply to that equipment. Unpaid charges for work on that equipment are collected under Sections 4 and 16, and Foxhole IT Solutions may decline further work until they are paid.
22. Monitoring, Maintenance & Subscriptions
This Section applies to monthly subscriptions for website monitoring and maintenance, server monitoring and maintenance, and any other recurring service.
Subscription Plans
Each plan's services, price, and limits are stated in a written plan, proposal, or invoice, and work outside the plan is billed hourly under Section 3. Before a subscription starts, the plan states the monthly price, that the subscription renews every month until cancelled, and how to cancel.
Billing
Subscriptions are billed monthly in advance by Square invoice or card on file, or by bank transfer through Square. By providing a card on file, the Business Client authorizes recurring monthly charges until the subscription is cancelled. The first payment is due before service begins, and each monthly invoice is due on the invoice date. The late fee in Section 4 applies to a balance unpaid after that date. Prices may change with 30 days' notice, and a Business Client that does not accept a price change may cancel before it takes effect without paying the new price. Foxhole IT Solutions may suspend the subscription services if a payment is more than 10 days overdue.
Term and Cancellation
Subscriptions are month to month and continue until cancelled, unless the plan states an annual term paid in advance. A prepaid block of hours does not expire for five years from the purchase date, is used at the rate in effect when it was purchased, and is not transferable. After five years, any unused balance is handled under Florida's unclaimed property law (Chapter 717, Florida Statutes). Either party may cancel a monthly plan with 30 days' written notice under Section 17. Fees through the end of the notice period remain due, and there are no prorated refunds for partial months. A client may cancel an annual plan at any time by written notice or email. Foxhole IT Solutions refunds the unused portion, calculated by full months remaining, less the value of any services already delivered under the plan and any discount the client received for paying annually. If Foxhole IT Solutions ends an annual plan for a reason other than non-payment or a reason in Section 13, the prepaid fee for the full months remaining is refunded. Foxhole IT Solutions may end a subscription sooner for non-payment or for a reason in Section 13. After cancellation, Foxhole IT Solutions stops monitoring, and the Business Client is responsible for securing its own systems.
What Monitoring Covers
Monitoring means the automated and manual checks listed in the plan, such as uptime, security alerts, updates, and backups. Alerts are handled on a best-effort basis during business hours unless the plan states otherwise in writing. Foxhole IT Solutions is closed on Friday and Saturday, and alerts received then are handled on the next business day unless the plan says otherwise. Foxhole IT Solutions is a single-technician business. A response time stated in a written plan is a target, and a resolution time is not guaranteed. Missing a target is not a breach of these policies and does not entitle the Business Client to a refund or credit.
No Uptime Guarantee
Foxhole IT Solutions does not guarantee that any website or server will be available, secure, or free of errors. It is not responsible for outages caused by hosting providers, internet carriers, power failures, software defects, attacks, changes made by the Business Client or others, or events outside its control (Section 17).
Maintenance, Backups, and Access
Software, plugin, and patch updates can cause compatibility problems. Foxhole IT Solutions may schedule maintenance windows, gives notice of planned downtime, may perform emergency maintenance without notice, and may decline an update that risks breaking the system. Backups are performed only if the plan includes them, and restore times are not guaranteed. The Business Client gives Foxhole IT Solutions the administrator access it needs, keeps accounts in the Business Client's name, and is responsible for the security of its passwords and the actions of its users. Foxhole IT Solutions uses access only for the service and is not responsible for breaches caused by compromised credentials, third-party vulnerabilities, failures caused by third-party updates, or the Business Client's refusal to approve recommended updates or replacement of unsupported software.
23. Equipment, Custom Builds & Purchasing
This Section applies to recommending, purchasing, delivering, installing, and configuring equipment such as computers, printers, scanners, and network equipment, and to custom PC builds.
Quotes and Purchasing
An equipment quote lists the items, their prices, and the setup labor. Equipment prices and availability can change, and Foxhole IT Solutions confirms them before ordering. A 50% deposit is required on any order over $200 under Section 4, and the balance is due on delivery. Equipment ordered for a Business Client is a special-order item.
Returns and Defects
Equipment ordered for a Business Client is not returnable. If equipment is defective on arrival, the Business Client reports it within 7 days, and Foxhole IT Solutions helps arrange the supplier's replacement or return.
Ownership
Equipment remains the property of Foxhole IT Solutions until it is paid in full.
Installation and Site Requirements
Installation happens at the Business Client's premises. The Business Client provides site access, power, network connections, and a safe workspace as described in Section 6.
Configuration and Data Migration
The Business Client backs up its data before setup, and any data transfer follows Section 9. Foxhole IT Solutions disposes of old equipment only on written request, for a fee quoted in advance, and securely erases it first.
Equipment Warranty
Equipment carries the manufacturer's warranty only. The 60-day labor warranty in Section 10 covers the workmanship of the installation and configuration. Helping with a manufacturer warranty claim is billed hourly. Basic orientation on new equipment is included, and additional training is billed hourly unless the estimate includes it.
Custom PC Builds and Upgrades
A custom build or upgrade is quoted from a parts list that the Business Client approves. Foxhole IT Solutions checks compatibility before ordering. Parts are special-order items that carry the manufacturers' warranties only, and a 50% deposit applies to orders over $200. Foxhole IT Solutions assembles, installs, and tests the build, and the labor warranty in Section 10 covers the workmanship. Operating system and other software licenses are the Business Client's responsibility. Performance figures, such as frame rates and benchmarks, are estimates and are not guaranteed, and overclocking or settings changed after delivery are not covered.
24. Website Services
This Section applies to website design, creation, updates, and related work.
Scope, Deposit, and Payment
A written proposal or estimate states the pages, features, platform, deliverables, price, and timeline. Work outside that scope needs a new estimate approved in writing and is billed under Hourly Billing in Section 3. A deposit is due when the estimate is approved, and work does not begin until it is paid. The deposit is 50% of the estimate for the Starter and Standard website packages and for other website projects. For the Premium package, the deposit is 40%, a further 30% is due at design approval, and the remaining 30% is due at launch. The balance is due before launch and before Foxhole IT Solutions hands over files and logins. The estimate includes two rounds of revisions to the design and content within scope, and additional revisions are billed hourly.
Business Content and Approvals
The Business Client provides text, images, logos, and other content on time and confirms that it owns or is licensed to use it. Foxhole IT Solutions is not responsible for infringement claims over content the Business Client supplies. Delays by the Business Client extend the timeline. If the Business Client does not respond for 30 calendar days, Foxhole IT Solutions may pause the project, and restarting it may require a new estimate. Foxhole IT Solutions may refuse, remove, or stop work on content that is illegal, infringing, deceptive, or harmful, and fees for work already completed remain due.
Ownership
The Business Client owns the content it supplies. When the project is paid in full, the Business Client owns the final website design and code that Foxhole IT Solutions created for it. Until then, Foxhole IT Solutions retains ownership. Foxhole IT Solutions keeps ownership of its own tools, templates, code libraries, and know-how and licenses them to the Business Client as part of the site. Third-party themes, plugins, fonts, and stock images stay under their own licenses. Foxhole IT Solutions may show the finished site in its portfolio and advertising unless the Business Client opts out in writing.
Domains, Hosting, and Credentials
Domain names, hosting, and platform accounts should be in the Business Client's name, and the Business Client is responsible for their renewals and fees. Foxhole IT Solutions may set up accounts on the Business Client's behalf, and those accounts belong to the Business Client. Foxhole IT Solutions is not responsible for outages, price changes, or policy changes of third-party providers, such as hosts, registrars, platforms, and email services. The Business Client provides the logins needed for the work, and Foxhole IT Solutions keeps them secure and does not keep them after the project unless a subscription under Section 22 applies. The Business Client should change passwords when the project ends.
Results, Compliance, and Third Parties
Foxhole IT Solutions does not guarantee website traffic, search rankings, leads, sales, or any other result. Legal and regulatory requirements for the site, such as accessibility, privacy policies, and cookie notices, are the Business Client's responsibility unless the estimate includes them in writing. Payments made on a website are processed by third-party payment processors that the Business Client contracts with, and Foxhole IT Solutions does not store or handle cardholder data. The Business Client is responsible for its merchant account, its compliance obligations to the processor, sales tax, shipping, refunds, and the legal terms for what it sells. Foxhole IT Solutions may set up and optimize a Google Business Profile, search settings, and analytics, but the Business Client owns those accounts, and Google and other platforms control their own rules, listings, and reviews. Foxhole IT Solutions is not responsible for suspensions, listing changes, removed or fake reviews, or ranking changes, and the Business Client is responsible for the privacy notices and consents that analytics and tracking require.
Launch and Acceptance
The Business Client reviews and approves the site before launch, and launching it is acceptance. A defect in Foxhole IT Solutions' work that is reported within 60 days of launch is fixed at no additional charge. New features, content changes, and problems caused by third-party platform updates are billed.
Cancellation
If the Business Client cancels before the project is finished, it pays for the work completed, and the deposit is applied to that charge and any remainder is refunded within 14 days.
