1. Acceptance of These Terms
These Terms of Service govern your use of the foxholeitsolutions.com website (the "Site") operated by Gulf Tech Solutions LLC d/b/a Foxhole IT Solutions ("Foxhole IT Solutions," "we," "us"). By using the Site, you agree to these terms and to our Privacy Policy, Cookie Policy and Website Policy. If you do not agree, please do not use the Site.
2. Our Services and the Policies & Procedures
The Site describes the repair, IT support, networking, setup and website design services we offer. Services are provided under our Policies & Procedures, which cover estimates, deposits, payment, warranty, data handling, liability, dispute resolution and more. You accept those policies when you check the acknowledgment box on a service intake form, booking form or service agreement, when you approve an estimate verbally, by text or by email, or when you pay an invoice. If these Terms conflict with the Policies & Procedures about a service, the Policies & Procedures control.
3. No Prices, Quotes or Contracts on the Site
The Site does not list prices. Every job is quoted individually after we understand your device and problem. Submitting a form, calling, texting or emailing is a request for information and a quote, not an order. A contract for service exists only when an authorized person approves an estimate under the Policies & Procedures. Descriptions of services, packages and add-ons on the Site are general and may change; each estimate or written agreement states what is included for your job.
4. Service Area and Hours
Mobile service is available only in Pinellas County, Florida. Remote support is available to clients outside the county. Appointments are by appointment only during our posted hours, which are Sunday 9 AM to 5 PM, Monday to Wednesday 8 AM to 5 PM, and Thursday 11 AM to 7 PM, and we are closed Friday and Saturday. Hours may change; the Policies & Procedures and your appointment confirmation control.
5. Use of the Site
You agree to use the Site lawfully and not to:
- submit false, misleading or another person's information, or impersonate anyone;
- send spam, malware or content that is unlawful, abusive, threatening or harassing;
- attempt to gain unauthorized access to the Site, its hosting, or other users' data;
- scrape, copy or republish the Site at scale, or interfere with its operation;
- use the contact forms or chat assistant for anything other than genuine inquiries.
We may block access or ignore submissions that violate these terms.
6. Content, Tech Tips and No Professional Advice
Articles, tech tips and chat assistant answers are general information to help you understand common problems. They are not a diagnosis of your device and do not create a service relationship. Technology varies, and following a tip could cause data loss or void a warranty. Back up your data first, use the tips at your own risk, and contact us if you are unsure. The chat assistant is automated and may be wrong; anything specific is confirmed only by us directly.
7. Intellectual Property
The Site, including its text, design, logo, illustrations, badges and code, is owned by or licensed to Gulf Tech Solutions LLC and protected by copyright and trademark law. "Foxhole IT Solutions" and the fox logo are our marks. Product names and logos of other companies (for example Apple, Samsung, Google, Microsoft, Sony, Nintendo) belong to their owners; we use them only to describe the devices we repair, and we are not affiliated with or endorsed by them. You may view and print Site content for personal, non-commercial use. Any other use needs our written permission.
8. What You Send Us
When you submit a form, review or message, you confirm that the information is accurate and that you have the right to share it. You give us permission to use it to respond to you and provide service. Customer reviews posted on third-party platforms such as Google belong to those platforms and their authors.
9. Third-Party Links and Services
The Site links to or loads services from other companies (for example Google, Instagram, YouTube, Yelp, Web3Forms, Netlify, Square). We do not control them and are not responsible for their content, availability or practices. Your use of them is governed by their own terms.
10. Disclaimer of Warranties
The Site is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including accuracy, completeness, availability, merchantability, fitness for a particular purpose and non-infringement. We do not promise the Site will be uninterrupted or error free. This disclaimer applies to the Site only. Repair warranties are described in Section 10 of the Policies & Procedures.
11. Limitation of Liability
To the fullest extent allowed by law, Foxhole IT Solutions and its owner, employees and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of or inability to use the Site, even if we were told they were possible. Liability relating to services is governed by Section 12 of the Policies & Procedures. Nothing here limits liability that cannot be limited under Florida law.
12. Indemnification
You agree to defend and hold harmless Foxhole IT Solutions from claims, damages and expenses (including reasonable attorney's fees) arising from your violation of these terms or your misuse of the Site.
13. Governing Law and Disputes
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes are handled under the steps in Section 16 of the Policies & Procedures (direct communication, then non-binding mediation, then the Small Claims Court or other courts of competent jurisdiction located in Pinellas County, Florida, or the federal court for the district that includes Pinellas County). The prevailing party in a legal action may recover reasonable attorney's fees and costs.
14. Changes and Severability
We may change the Site or these terms at any time by posting the update with a new date. If any part of these terms is found unenforceable, the rest stays in effect. Not enforcing a term is not a waiver of it.
